Terms of Service for FokusFamilie
for organisation licences and the Professional subscription in the desktop applications
Last updated: 22 October 2026
Part A – General
1. Provider and scope
1.1 The provider and manufacturer of the FokusFamilie software is Software Notion, owner Sebastian Kruse, Kornblumenring 40, 31600 Uchte, Germany, email: focusfamily@software-notion.de ("Provider").
1.2 These terms apply to (a) the purchase of organisation licences (seats) for FokusFamilie (Part B) and (b) the Professional subscription taken out in the FokusFamilie desktop applications for Windows, macOS and Linux ("Desktop Subscription", Part C). The use of the apps is additionally governed by the End User License Agreement (EULA). In case of conflict, these terms prevail.
1.3 Organisation licences are aimed exclusively at businesses within the meaning of Section 14 of the German Civil Code (BGB), legal entities under public law and special funds under public law, in particular providers of child and youth welfare services ("Customer"). Organisation licences are not sold to consumers.
1.4 The Desktop Subscription is available to consumers within the meaning of Section 13 BGB and to businesses within the meaning of Section 14 BGB ("User"). Provisions that apply only to consumers are marked as such.
1.5 These terms do not apply to Professional subscriptions taken out in the Apple App Store or on Google Play. Those are governed by the terms of the respective store operator and the EULA.
2. Reseller, contracting party and payment processing
2.1 Our order process is conducted by our online reseller Paddle.com Market Limited ("Paddle"). Paddle is the Merchant of Record for all orders of organisation licences and Desktop Subscriptions and is therefore the seller and the contracting party of the purchase. Paddle provides all customer service inquiries regarding payments and invoices and handles returns.
2.2 The purchase is additionally subject to Paddle's buyer terms (paddle.com/legal/checkout-buyer-terms). Paddle issues the invoice and shows the applicable VAT. The licence, the rights of use and the provision of the features are governed by these terms and the EULA; the Provider is responsible for them.
2.3 These terms can be accessed on this page at any time and can be saved and printed. The contract languages are German and English.
Part B – Organisation licences
3. Scope of service
3.1 An organisation licence entitles the Customer, for each purchased seat, to let one named person use the FokusFamilie apps with the features of the Professional edition, including the connection to the Customer's server. The number of devices per seat is limited (three by default).
3.2 The Customer runs the server and admin panel on its own infrastructure or infrastructure it has commissioned. The Provider does not host any Customer data and has no access to case or personal data.
3.3 Delivery is purely digital: after payment, the Provider's licence server activates the purchased seats automatically. The Customer assigns them to its staff in the admin panel. Physical goods, hosting, consulting and training are not part of the organisation licence.
4. Prices and payment
4.1 The prices stated at the time of the order apply. A seat currently costs EUR 9.99 per month or EUR 99.99 per year, plus statutory VAT where applicable. The Paddle checkout shows the final amount before payment.
4.2 Payment is made in advance for the chosen billing period using the payment methods offered by Paddle.
4.3 Price changes apply only to future billing periods and are announced by email at least 30 days before they take effect. The Customer may cancel before then.
5. Term, changes to seats and cancellation
5.1 The organisation licence is a subscription and renews automatically for the chosen period (month or year) unless cancelled.
5.2 The Customer can change the number of seats at any time in the admin panel. Additional seats can be used immediately and are charged pro rata for the current period. A reduction takes effect at the end of the paid billing period; until then all paid seats remain usable. No credit is given for the current period. A switch between monthly and yearly billing, however, takes effect immediately and is prorated.
5.3 The Customer can cancel at any time with effect from the end of the current billing period by setting the number of seats to zero in the admin panel or by emailing the Provider. The seats remain usable until the end of the period; a scheduled cancellation can be withdrawn in the admin panel until then. Refunds of amounts already paid are governed by the Refund Policy.
5.4 After the organisation licence ends, the Professional features are no longer available through this licence. All data already recorded remains fully available and exportable; no data is deleted or locked.
6. Customer obligations
6.1 The Customer is responsible for operating, securing, updating and backing up its server and keeps access credentials and licence keys confidential.
6.2 The Customer is the controller within the meaning of the GDPR for the personal data processed on its server and in its staff's apps.
6.3 Seats may only be assigned to persons working for the Customer. Seats may not be passed on to third parties.
Part C – Professional subscription in the desktop applications
7. Scope of service
7.1 The desktop applications can be used free of charge. For the duration of the subscription, the Desktop Subscription unlocks the features of the Professional edition. The free features remain usable regardless.
7.2 The subscription is bound to the anonymous Focus Family ID that the app creates when needed (at the latest when the subscription is taken out) and under which the subscription was taken out. No user account with the Provider is required; the Provider receives neither the User's name nor email address. The details Paddle collects for ordering and payment are processed by Paddle under its own responsibility.
7.3 The Focus Family ID works across all platforms. A Desktop Subscription therefore also unlocks the Professional edition in the iOS and Android apps if the same Focus Family ID is used there. The number of devices per Focus Family ID is limited (three by default).
7.4 Using the Focus Family ID on another device requires the Focus Family ID and the recovery code. The User keeps both safe and does not pass them on to third parties. Because the Provider keeps no user account, it cannot restore a lost Focus Family ID. Even then, the subscription can still be managed and cancelled through Paddle's emails.
7.5 Delivery is purely digital: after successful payment, the Provider's licence server automatically activates the Professional edition for the Focus Family ID. The app applies the activation at the next licence check, which requires an internet connection.
7.6 If the desktop application is connected to an organisation's server, the organisation decides whether a personal Professional subscription can be used there.
7.7 The Desktop Subscription is intended for use by the User. It may not be passed on to third parties.
8. Prices and payment
8.1 The Desktop Subscription is offered with monthly or yearly billing. The prices stated at the time of the order apply. Before the order is placed, Paddle's checkout shows the total price including statutory VAT.
8.2 Payment is made in advance for each billing period using the payment methods offered by Paddle.
8.3 Price changes apply only to future billing periods. For consumers, a price increase for an existing subscription only takes effect with their express consent; if the consumer does not consent, the subscription continues at the previous price and the Provider may terminate it with at least one month's notice to the end of a billing period. Businesses are notified of a price change at least 30 days before it takes effect, in the app or in text form; they may cancel before then.
9. Contract term, payment rhythm, renewal and cancellation
9.1 The Desktop Subscription begins with the successful payment. The contract term and the payment rhythm are two different things: the payment rhythm (monthly or yearly) only determines the period for which the fee is charged in advance each time ("billing period"). The initial contract term corresponds to the first billing period, i.e. one month or one year. After that: (a) for consumers, every Desktop Subscription, whether with a monthly or a yearly payment rhythm, continues for an indefinite period after the initial contract term unless cancelled. The consumer can then cancel it at any time with at most one month's notice (clauses 9.2 and 9.3). The fee continues to be charged in advance in the chosen payment rhythm. (b) For businesses, the Desktop Subscription renews after the initial contract term by a further billing period each time unless it is cancelled with effect from the end of the current billing period.
9.2 During the initial contract term, the User can cancel at any time with effect from its end, without any further notice period. After that, a consumer with a monthly payment rhythm can cancel at any time with effect from the end of the current billing period, i.e. with at most one month's notice; clause 9.3 applies to consumers with a yearly payment rhythm. Businesses can cancel at any time with effect from the end of the current billing period. No reasons need to be given. Cancellation is possible via the cancellation page "Cancel contracts here" on this website (cancellation page, also linked in the footer of every page), in the desktop application under "Manage subscription", which opens Paddle's customer portal, via the links in Paddle's emails or by a declaration in text form, for example by email to focusfamily@software-notion.de. The Provider confirms a cancellation made on the cancellation page immediately on the page and by email, stating the date and time of receipt, and then carries it out with Paddle. The Professional edition remains usable until the cancellation takes effect.
9.3 For consumers with a yearly payment rhythm, the following applies after the initial contract term (the first year): the consumer can cancel it at any time with one month's notice. The cancellation takes effect one month after it is received unless the consumer chooses a later date; if the current billing period ends earlier, it takes effect at the end of that period. The fee continues to be charged yearly in advance; fees already paid for the time after the cancellation takes effect are refunded pro rata. A cancellation via "Manage subscription" or Paddle's customer portal technically takes effect at the end of the current billing period; anyone who wants to cancel earlier with one month's notice uses the cancellation page ("at the earliest possible date") or informs the Provider in text form, for example by email to focusfamily@software-notion.de. The Provider then ends the subscription on the termination date and arranges the refund through Paddle.
9.4 Both parties' right to terminate for good cause remains unaffected.
9.5 After the subscription ends, the Professional features are no longer available. All data already recorded remains fully available and exportable; no data is deleted or locked.
9.6 A full refund of the latest payment, for example after a withdrawal, and a reversal of the payment (chargeback) end the Professional edition immediately. Pro rata refunds under clause 9.3 keep the subscription in place until the termination date.
9.7 The User can delete their Focus Family ID in the app at any time after an explicit confirmation, including while a Desktop Subscription is running or a payment process is still open. Before the confirmation, the app points out the following consequences. Deleting the ID cancels a running Desktop Subscription immediately and aborts any open payment process; the subscription no longer renews, and the Professional edition is no longer available for this Focus Family ID. A payment that is only completed after the deletion request is refunded automatically. Otherwise, the part of the billing period that has already been paid for but has not yet expired lapses; to that extent, no refund is made automatically. Statutory rights, in particular the right of withdrawal under clause 10 and rights in respect of defects, as well as the claim to a pro rata refund under clause 9.3 remain unaffected; they can be asserted by email to focusfamily@software-notion.de, stating the Paddle order number, and the withdrawal also via the withdrawal function under clause 10.2. The deletion is normally carried out immediately and, if the payment service is temporarily unreachable, usually within 24 hours. If the automatic cancellation does not succeed within 14 days, the Provider carries it out manually; the deletion is completed afterwards. Until then, the Focus Family ID remains blocked and only the data needed for the cancellation is kept. The app shows the processing status via a reference that is valid only for this deletion request (no email address is needed for this) and confirms when the deletion is complete. The refund of a payment completed after the deletion request is completed independently, even if the deletion has already been completed. Data recorded in the app is not affected by deleting the Focus Family ID.
10. Consumers' right of withdrawal
10.1 Consumers have a statutory right of withdrawal of 14 days when buying a Desktop Subscription. Paddle is the seller and the contracting party of the purchase; the withdrawal can be declared to Paddle or to the Provider. A withdrawal received by the Provider is honoured and carried out through Paddle. The withdrawal period, how to exercise the right, the consequences of withdrawal and the model withdrawal form are set out in Paddle's withdrawal information and buyer terms (paddle.com/legal/checkout-buyer-terms).
10.2 For the withdrawal, the Provider offers the withdrawal function "Withdraw from contract here" on this website (withdrawal page, also linked in the footer of every page; in German "Vertrag widerrufen"). There, the consumer enters their name, a detail identifying the contract (Focus Family ID, Paddle order or subscription number or the email address used for the purchase) and the email address for the confirmation of receipt, and confirms the withdrawal with the button "Confirm withdrawal" (in German "Widerruf bestätigen"). The Provider confirms receipt without delay on the page and by email, stating the content of the withdrawal and the date and time of receipt. A withdrawal submitted via the withdrawal function before the withdrawal period expires is in time. The Provider carries out the withdrawal through Paddle and arranges the refund, which Paddle as the seller makes to the original payment method. In addition, the withdrawal can still be declared via the link in Paddle's purchase confirmation, at paddle.net or by an unequivocal statement to focusfamily@software-notion.de.
10.3 The conditions under which the right of withdrawal for digital content and digital services expires early are governed by law (Section 356(5) and (6) BGB) and by the declarations the consumer makes in Paddle's checkout.
11. User obligations
11.1 The User keeps the Focus Family ID and recovery code confidential and does not circumvent licensing or security mechanisms.
11.2 The User backs up their data regularly using the app's backup and export functions.
Part D – Common provisions
12. Warranty and liability
12.1 Statutory warranty rights apply, for consumers in particular the provisions on digital products (Sections 327 et seq. BGB). The Provider remedies defects within a reasonable period through updates.
12.2 The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulently concealed defects, to the extent of any guarantee given and under the Product Liability Act. Otherwise, in cases of simple negligence, the Provider is liable only for breaches of essential contractual obligations, i.e. obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the other party may regularly rely; in that case liability is limited to the typical, foreseeable damage.
12.3 Where an organisation or Customer operates its own server with the server software supplied by the Provider, the Provider is not liable for damage to the extent that it is based on circumstances within the responsibility of the organisation, the Customer or third parties, in particular the operation, configuration, security or availability of the infrastructure chosen for it (such as hardware, network, operating system, database or hosting provider), missing or inadequate backups, or updates supplied by the Provider not having been installed. The Provider is liable for defects in the software it supplies under clauses 12.1 and 12.2.
12.4 In cases of simple negligence, liability for loss of data is limited to the effort that would have been required to restore it had the Customer or User made regular backups appropriate to the risk.
12.5 Liability under clause 12.2 sentence 1 remains unaffected by clauses 12.3 and 12.4; in addition, clause 12.3 does not restrict liability for breaches of essential contractual obligations under clause 12.2 sentence 2. The statutory warranty rights under clause 12.1 remain unaffected.
13. Data protection
The privacy policy for the app describes which data the Provider and Paddle process for purchases and licence checks.
14. Final provisions
14.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the User is a consumer, mandatory consumer protection provisions of the state of their habitual residence remain unaffected.
14.2 If the Customer or User is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the Provider's registered office.
14.3 The Provider may amend these terms with effect for future billing periods. Material changes for organisation licences are announced by email at least 30 days in advance; the Customer may cancel before they take effect. Changes for Desktop Subscriptions of businesses are announced at least 30 days in advance in the app or in text form; the User may cancel before they take effect. For consumers, changes to these terms for a running Desktop Subscription only take effect with the consumer's express consent; continued use of the app does not constitute consent. If the consumer does not consent, the subscription continues under the previous terms. Price changes are governed by clause 8.3. Changes to the app itself (updates, changes to features) are governed for consumers by Section 327r BGB and clauses 7.3 and 7.4 of the EULA.
14.4 The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (VSBG).
14.5 Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
