Software Notion

End User License Agreement (EULA) for FokusFamilie

Effective: 22 October 2026

This End User License Agreement ("Agreement") governs the use of the application FokusFamilie (the "App"), including its optional subscriptions ("Professional"), between you (the "User") and

Software Notion, owner Sebastian Kruse, Kornblumenring 40, 31600 Uchte, Germany, phone: , e-mail: focusfamily@software-notion.de (the "Provider").

The App is distributed through the Apple App Store, Google Play and as a direct download for desktop systems. For purchases through the Apple App Store, the provisions in Section 13 in favour of Apple apply in addition. This Agreement replaces Apple's standard Licensed Application End User License Agreement to the extent it deviates from it; it contains at least the minimum terms required by Apple.

1. Subject matter

1.1 The App supports social-work practitioners (e.g. family support services) with organisation, documentation and time tracking. It works locally on the User's device ("offline first"). A connection to a server operated by the User's own organisation (the "Organisation Server") is optional.

1.2 The App does not replace professional judgement, legal advice or the requirements of the organisation or the competent authorities.

2. Scope of licence

2.1 The Provider grants the User a non-exclusive, non-transferable, revocable right to install and use the App on devices the User owns or controls and that comply with the usage rules of the respective distribution channel (e.g. the Apple Media Services Terms).

2.2 The User may not rent, lease, lend, sell, redistribute or sublicense the App, may not reverse engineer, decompile or disassemble it except where mandatory law permits, and may not circumvent security or licensing mechanisms.

2.3 Where an organisation purchases licences for several users ("Organisation Licence"), the agreements between the organisation and the Provider take precedence. In that case the organisation is the controller within the meaning of the GDPR for the data processed on its Organisation Server.

3. Editions and subscriptions

3.1 The App can be used free of charge ("Free"). Additional features form part of the "Professional" edition. It can be purchased as a subscription through the App Store or Google Play (in-app purchase), as a subscription in the desktop applications for Windows, macOS and Linux, or as part of an Organisation Licence. A subscription applies to the Focus Family ID under which it was taken out, on all platforms on which the User uses that ID; the number of devices per ID is limited (three by default).

3.2 Subscriptions purchased through the App Store or Google Play are billed through the User's account with the respective platform operator. They renew automatically for the selected period unless cancelled at least 24 hours before the end of the current period. Prices, periods and any trial phases are shown in the store before purchase. They are cancelled and managed exclusively in the account settings of the platform operator (e.g. Settings → Apple ID → Subscriptions). A period already paid for is not refunded pro rata upon cancellation unless required by law. The platform operator gives advance notice of price changes; the User may cancel before the change takes effect.

3.3 Subscriptions taken out in a desktop application are sold by Paddle.com Market Limited as reseller (Merchant of Record); Paddle is the contracting party of the purchase and handles billing. Paddle's buyer terms and the FokusFamilie Terms of Service, which govern term, renewal, cancellation and price changes, apply in addition. These subscriptions are cancelled and managed in the desktop application under "Manage subscription" or via the links in Paddle's emails.

3.4 Organisation Licences are governed by the agreements between the organisation and the Provider, in particular the FokusFamilie Terms of Service.

3.5 After a subscription ends, all data already recorded remains accessible and exportable. No data is deleted or locked; only the Professional features become unavailable.

4. Right of withdrawal

4.1 Consumers have a statutory right of withdrawal for digital content and subscriptions. It is exercised against the respective contracting party of the purchase.

4.2 For in-app purchases through the App Store or Google Play, its exercise and expiry are governed by the terms of the respective platform operator, who is the contracting party of the purchase. Refund requests must be directed to Apple or Google.

4.3 For subscriptions taken out in the desktop applications, the withdrawal is declared to Paddle as the seller or via the withdrawal function "Withdraw from contract here" (in German "Vertrag widerrufen") on the FokusFamilie website; a withdrawal received there or by the Provider is honoured and carried out through Paddle. Details are set out in Paddle's withdrawal information and buyer terms and in the FokusFamilie Terms of Service.

4.4 Organisation Licences are sold only to businesses and public bodies; no consumer right of withdrawal applies to them.

5. Data, privacy and responsibility

5.1 Case and personal data recorded in the App is stored encrypted locally on the device. The Provider has no access to this data. When an Organisation Server is used, data is transmitted exclusively to the server designated by the organisation; that server is not operated by the Provider.

5.2 The User or their organisation is responsible, as controller, for the lawfulness of processing personal data of third parties (clients, relatives), in particular for the legal basis, information duties, retention and deletion periods and compliance with social data protection law (Sections 35 SGB I, 67 et seq. SGB X, Section 203 StGB in Germany).

5.3 To provide the licence, the Provider processes a pseudonymous user identifier, a device identifier, platform and app version as well as the licence status. For in-app purchases, purchase information is processed through the service provider RevenueCat. For purchases through Paddle, the Provider receives identifiers, status and billing period of the subscription from Paddle, but no payment details. Details are set out in the privacy policy for the App at https://focusfamily.software-notion.de/privacy.

5.4 Crash reports are only sent to a connected Organisation Server and contain technical information without case content. Sending is active by default, serves troubleshooting in the interest of the organisation (Art. 6(1)(f) GDPR) and can be switched off in the settings at any time.

6. Obligations of the User

6.1 The User secures their devices by means of the device lock and the app lock, keeps credentials confidential and creates regular backups using the App's backup function. If the device key is lost (e.g. the device is reset without a backup), the local data is irretrievably lost.

6.2 The User uses the App only within the applicable laws and the requirements of their organisation.

7. Maintenance and support

7.1 The Provider is solely responsible for maintenance and support of the App. Apple and Google have no obligation whatsoever to furnish any maintenance or support services with respect to the App.

7.2 Support is provided by e-mail to focusfamily@software-notion.de or through https://software-notion.de/contact. Specific response times are only guaranteed within a separately agreed Organisation Licence.

7.3 The Provider may update the App and change or discontinue features; the core function (local documentation and export of the User's own data) is always preserved. Towards consumers to whom the provisions on contracts for digital products apply (Sections 327 et seq. of the German Civil Code), in particular under a paid subscription, the Provider makes changes that go beyond what is necessary to keep the App in conformity with the contract only if (a) there is a valid reason, such as fixing security vulnerabilities, implementing changed legal or regulatory requirements, adapting to new versions of operating systems, devices or distribution platforms, or the technical development of the App, (b) the consumer incurs no additional costs as a result and (c) the consumer is informed about the change in a clear and comprehensible manner.

7.4 If such a change impairs the consumer's access to the App or its usability more than insignificantly, the Provider additionally informs the consumer in good time before the change, on a durable medium, about the characteristics and the time of the change and about their right to terminate the contract free of charge within 30 days. The period begins when this information is received or, if the change is made later, at the time of the change (Section 327r(2) and (3) of the German Civil Code). The termination can in particular be declared to the Provider, for example by email to focusfamily@software-notion.de. There is no right to terminate if the Provider enables the consumer to keep the unchanged version without additional costs and that version remains in conformity with the contract (Section 327r(4) of the German Civil Code).

8. Warranty

8.1 For features provided free of charge, the Provider is liable only for fraudulently concealed defects.

8.2 For paid subscriptions, the statutory warranty rights for digital products apply (Sections 327 et seq. of the German Civil Code). In case of a defect the Provider does not remedy within a reasonable period, the User may terminate the contract in accordance with statutory provisions.

8.3 To the extent permitted by law, the Provider does not warrant that the App will be uninterrupted, error-free or fit for a particular purpose. For purchases through the App Store, in the event of any failure of the App to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price (if any) for the App to the User. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

9. Liability

9.1 The Provider is liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, for fraudulently concealed defects, to the extent of any guarantee given, and under the German Product Liability Act.

9.2 Otherwise, in cases of slight negligence, the Provider is liable only for breach of essential contractual obligations (cardinal duties), i.e. obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the User may regularly rely; in that case liability is limited to the foreseeable damage typical for the contract.

9.3 The Provider is not liable for damage to the extent that it is based on circumstances within the responsibility of the User, their organisation or third parties, in particular loss, theft or reset of the device, deletion of the device key, the operation, configuration, security or availability of an Organisation Server and the infrastructure chosen for it, missing or inadequate backups, or updates supplied by the Provider not having been installed. The Provider is liable for defects in the software it supplies, including the server software, under Sections 8 and 9.

9.4 In cases of slight negligence, liability for loss of data is limited to the effort that would have been required to restore it had the User made regular backups appropriate to the risk.

9.5 Liability under clause 9.1 remains unaffected by clauses 9.3 and 9.4; in addition, clause 9.3 does not restrict liability for breaches of essential contractual obligations under clause 9.2. Statutory warranty rights (Section 8) remain unaffected.

10. Product claims and third-party claims

The Provider, not Apple or Google, is responsible for addressing any claims of the User or any third party relating to the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

11. Intellectual property

11.1 All rights in the App, its content, trademarks and documentation remain with the Provider or its licensors. Notices for open-source components are available in the App or under "THIRD-PARTY-NOTICES".

11.2 In the event of any third-party claim that the App infringes that third party's intellectual property rights, the Provider, not Apple, is solely responsible for the investigation, defence, settlement and discharge of any such claim.

12. Export control and legal compliance

The User represents and warrants that they are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that they are not listed on any U.S. Government list of prohibited or restricted parties. The User complies with all applicable laws when using the App.

13. Special provisions for the Apple App Store

13.1 This Agreement is concluded solely between the User and the Provider, not with Apple. The Provider, not Apple, is solely responsible for the App and its content.

13.2 The licence is limited to use of the App on Apple-branded products that the User owns or controls, as permitted by the usage rules set forth in the Apple Media Services Terms and Conditions; the App may be used through Family Sharing or volume purchasing where provided for.

13.3 Apple, Inc. and its subsidiaries are third-party beneficiaries of this Agreement. Upon the User's acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against the User as a third-party beneficiary.

13.4 Questions, complaints and claims regarding the App must be directed to the Provider: Software Notion, Kornblumenring 40, 31600 Uchte, Germany, phone: , focusfamily@software-notion.de.

13.5 When using the App, the User must comply with applicable third-party terms (e.g. mobile carrier agreement, terms of use of an Organisation Server).

14. Term and termination

14.1 This Agreement applies for as long as the User uses the App. The User may terminate it at any time by uninstalling the App; their own data should be exported beforehand.

14.2 The Provider may terminate the licence with reasonable notice in the event of material breaches of this Agreement. Locally stored data is unaffected and remains exportable.

15. Final provisions

15.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the User is a consumer, mandatory consumer protection provisions of their state of residence remain unaffected.

15.2 If the User is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the Provider's registered office.

15.3 The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (VSBG).

15.4 Should individual provisions of this Agreement be invalid, the validity of the remaining provisions remains unaffected.

15.5 The Provider may amend this Agreement with effect for the future if there is a valid reason, such as a change in the law or case law, changed requirements of the distribution platforms or new features of the App. Material changes are announced in the App, on the website or by email (if the address is known). For use free of charge, the amended version applies to use after it takes effect; anyone who does not agree can stop using the App at any time and export their data beforehand. For consumers with a running paid subscription, amendments to this Agreement only take effect with the consumer's express consent; continued use does not constitute consent, and without consent the previous version continues to apply to the subscription. Businesses with a paid subscription are notified of amendments at least 30 days before they take effect and may cancel the subscription until then. Changes to the App itself are governed by clauses 7.3 and 7.4.
